The Growing Role of Video Evidence in Criminal Prosecutions

The advent of dash cams and body cams in law enforcement has fundamentally transformed the criminal justice landscape. These are questions to which video can provide definitive answers, and for this reason, it is often a cornerstone in a strong defense strategy.

Officers are aware that their actions are being recorded, and this may further compliance with procedures and best practices. It can also serve to clear officers from false allegations of misconduct, which helps in building trust between the public and law enforcement agencies.

One of the biggest ways video evidence impacts a case is in the shaping of strategy. For instance, clear video footage that corroborates a defendant’s version of events strengthens the case for taking the matter to trial. On the other hand, if the evidence is not favorable, it will help the defense negotiate a plea deal to minimize the consequences.
